Grupo Tuinbit SL operates the service under the trading name Tekeum.
2. Purpose
These terms and conditions govern access to, browsing and use of the Site, as well as the general conditions applicable to requests for information, demos and contracting of Tekeum services.
Accessing the Site implies acceptance of these terms. If you do not agree, you must refrain from using the Site.
3. Description of services
Tekeum provides a turnkey service for creating, managing and publishing audio guides, audio description (AD), sign language guides, geolocated routes and kids' audio guides for cultural and heritage institutions. Content is produced from the official sources provided by each institution and goes through human review before publication.
Information published on the Site is descriptive and does not constitute a binding contractual offer. The specific conditions of each project (scope, pricing, timelines and deliverables) are set out in the proposal or quote Tekeum sends to each institution, which takes precedence over the general Site information.
4. Conditions of use
Users agree to use the Site lawfully and in accordance with these terms, refraining from:
- Activities that could damage, overload or deteriorate the Site or prevent its normal operation.
- Introducing or spreading computer viruses or any system that could cause damage.
- Attempting to access restricted areas of the Site or the app.tekeum.com platform without authorisation.
- Using Site content for commercial purposes without Tekeum's express permission.
5. Free demos
Tekeum may produce free audio guide demonstrations using content from the interested institution. Demos:
- Are illustrative and non-commercial.
- Are produced from publicly available official sources.
- May contain errors, as indicated in the demo content itself.
- Create no obligation to contract for either party.
- May be removed by Tekeum at any time and will be removed immediately upon the institution's request.
6. Service contracting
Contracting Tekeum services is formalised by written acceptance of the corresponding proposal or quote, which details: scope and deliverables, prices, payment terms and timelines, and specific conditions applicable to the project.
In case of discrepancy between these general terms and the specific conditions of an accepted proposal, the latter shall prevail.
7. Institution-provided content
The client institution warrants that it holds the necessary rights over the texts, images and other materials it provides to Tekeum, and indemnifies Tekeum against third-party claims arising from the use of those materials.
8. Intellectual and industrial property
The technology platform, software, design, structure and own content of the Site are owned by Tekeum or its licensors and are protected by intellectual and industrial property law.
Rights over content produced for each institution (scripts, audio, translations) are governed by the corresponding proposal or contract.
9. Limitation of liability
Tekeum does not guarantee uninterrupted availability of the Site but will take reasonable measures to ensure continuity. Tekeum is not liable for: damages arising from use of the Site contrary to these terms; interruptions, errors or failures beyond its reasonable control; or the content of third-party websites linked from the Site.
10. Data protection
Personal data collected through the Site is governed by the Privacy policy and the Cookies policy.
11. Modifications
Tekeum reserves the right to modify these terms at any time. Changes will be published on the Site with the date of the last update.
12. Applicable law and jurisdiction
These terms are governed by Spanish law. The parties submit to the Courts and Tribunals of Ciudad Real for the resolution of any disputes arising from access to or use of the Site, unless applicable law requires a different forum.
